Terms of Service
I. MAKEUP POLICY
We do understand that from time to time it may be unfeasible for your child to attend a class. We have heard it all before! You will accrue 1 makeup token for 1 missed enrollment. Make-up tokens may only be redeemed for age appropriate and similar value classes/lessons, subject to time availability. Make-ups must be used within the same month they were earned. Children under 4 Years and 9 months old do not qualify for night outs. Parents must contact the administrator 24 hours in advance of a missed class to qualify for a make-up token otherwise no token will be earned.

II. DROP PROCEDURE:
PARENTS MUST NOTIFY THE ADMINISTRATOR TO DROP A CHILD FROM CLASS ENROLLMENT. You will continue to be enrolled and billed each month until a drop request is provided.

Please note: You are responsible for payment for your child's classes WHETHER OR NOT YOUR STUDENT ATTENDS CLASS until the time you notify the staff of a drop date. Please do not rely on your child to let us know that he/she will no longer be attending classes. If a child stops coming to class without parent notification to drop class enrollment then that family's account will continue to be charged up to the point our staff is notified. Once a child drops class their position can no longer be saved.

III. WHAT TO WEAR
All children should have activity-appropriate clothing and footwear during class. Please be advised that clothing may get dirty or permanently stained at art or any other class. Do not wear articles of clothing that you do not want to get dirty or damaged. Jewelry should not be worn during classes. PLEASE LEAVE JEWELRY ARTICLES AT HOME. Our facility's staff will not be responsible for ANY items that may be lost or stolen. We recommend your family's personal items are marked with your name.

IV. ARRIVAL AND PICKUP
Be sure your child arrives no earlier than 5 minutes before his/her scheduled class time. Please pick up your child on time. Please inform the teacher or coach if you know you will be late picking up your child to arrange support. Instruct your child to wait inside the building and you should escort them from the building to your car. During peak times the parking lot is crowded. Please take into consideration that our children may include young children. Please drive slowly and carefully. Do not take a chance on your child running to and from your car."

V. PAYMENTS
I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card or bank account draft (ACH Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.
I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my ACH draft, or credit card account. I understand that a 30 day written notice is required to terminate billing and I am responsible for payment whether or not my student attends classes until I notify this facility in writing to drop my student from class(es).
Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.

VI. INJURIES
As legal guardian of my designated student(s) (student(s)), I hereby consent to all student(s) participating in this facility's program(s). I recognize that potentially severe injuries may occur in any activity. I understand that it is the express intent of all staff and personnel to provide for the safety and protection of my student(s) and, in consideration for allowing my student(s) to use these facilities, I hereby COVENANT NOT TO SUE and FOREVER RELEASE this facility, affiliated and partner companies and organizations, property owners and lessors, staff, contractors, subcontractors, teachers, coaches, owners, directors and other members involved in this facility's program(s), from all liability and for any and all damages and injuries suffered by my student(s) during instruction, supervision, and/or control during any and all classes or extra activities.

VII. COVID-19 and other transmittable diseases:
As legal guardian of my designated student(s) (student(s)), I hereby consent to all student(s) participating in this facility's program(s). I recognize that my child may contract COVID-19 or other transmittable disease through interaction with other people at the facility. This facility will adhere to the California Department of Public health requirements for operating safely. My Student(s) and I will comply with the imposed health and safety requirements imposed by the regulating authority and by this facility. I hereby COVENANT NOT TO SUE and FOREVER RELEASE this facility, affiliated and partner companies and organizations, property owners and lessors, staff, contractors, subcontractors, teachers, coaches, owners, directors and other members involved in this facility's program(s), from all liability and for any and all illnesses suffered by my student(s) during instruction, supervision, and/or control during any and all classes or extra activities.

VIII. PHOTO CONSENT
As legal guardian of my designated student(s), I hereby consent to my student(s)' photos being used in social media, staff training material, advertisements, product offerings, or stored on KMCD Creative Enterprises LLC devices.
